THE SHORT VERSION
PLEASE READ CAREFULLY: these terms contain a binding arbitration provision and a class action waiver (section 8). They affect your legal rights.
1. Accounts & eligibility
You must be 13 or older to use the store and 18 or older to buy. You are responsible for what happens under your account.
2. Face Search & biometric consent
Face Search runs only when you start it and only after you consent in writing on the screen before it. Consent can be withdrawn at any time; withdrawing it deletes your saved face and stops future searches.
The Biometric Data Policy is part of these Terms.
3. Purchases, pricing & refunds (USD)
Prices are in US dollars and shown before you pay. Payment is processed by Stripe.
Because a photo is delivered digitally and immediately, purchases are final once the file is downloaded. If a file is wrong, corrupted or not of you, write to us within 30 days and we will refund it.
4. Your photo license — personal use
When you buy a photo you get a personal, non-exclusive, worldwide licence: print it, post it, share it, put it on your wall.
What the licence does not cover: reselling the photo, licensing it to anyone else, or using it to advertise a product or service. The photographer keeps the copyright.
5. Acceptable use
Do not scrape the store, try to reach photos that are not yours, remove watermarks from previews, or run a Face Search on someone else's face. Any of these ends your access.
6. Copyright & DMCA
If you believe a photo infringes your copyright, write to legal@picsports.io with the work, the URL, your contact details and a statement made under penalty of perjury. We remove first and ask questions after, and we terminate repeat infringers.
7. Disclaimers & limitation of liability
The store is provided as is. Face Search is a best effort — it can miss photos of you and it can suggest photos that are not you.
To the extent the law allows, our total liability is limited to what you paid us in the 12 months before the claim.
8. Binding arbitration & class action waiver
You and PicSports agree to resolve disputes by individual binding arbitration under the rules of the American Arbitration Association, in New York, NY — not in court and not as a class action.
You may opt out within 30 days of first accepting these Terms by writing to legal@picsports.io. Either of us may still bring an individual claim in small claims court.
9. Governing law — New York
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.
